These Terms & Conditions (“Terms”) govern your access to and use of the CalMate mobile application, website, and related services (collectively, the “Service”).
By using CalMate, you agree to these Terms.
If you do not agree, do not use the Service.

2. Eligibility
You must be at least 13 years old (or the minimum legal age in your country) to use the Service.
If you are below the age of majority, you must have parent/guardian permission.
3. Account
You are responsible for:
- maintaining account credential confidentiality;
- accuracy of account information;
- activity under your account.
You must notify us if you suspect unauthorized access.
4. Service Description
CalMate provides tools for nutrition and wellness tracking, which may include:
- meal and macro logging;
- barcode and custom food entries;
- AI-assisted meal and exercise features;
- hydration and fasting features;
- progress and analytics views;
- optional Apple Health integration;
- cloud sync for authenticated users.
Features may vary by plan, region, app version, and device compatibility.
5. No Medical Advice
CalMate is not a medical device and does not provide medical diagnosis or treatment.
Information and AI outputs are informational only and may be inaccurate.
Always consult qualified professionals before making health decisions.
6. AI Features
AI features are estimate-based and may be incomplete or incorrect.
You are responsible for reviewing outputs before relying on them.
By using AI features, you authorize processing of submitted inputs (for example text/images) by CalMate and authorized processing providers for feature delivery and improvement of reliability/safety.
7. User Content
“User Content” means data you upload or create (for example logs, photos, notes, and related content).
You retain ownership of your User Content.
You grant CalMate a worldwide, non-exclusive, royalty-free license to host, store, process, display, and transmit User Content solely to operate, secure, and improve the Service.
You represent that you have rights to submit your User Content and that it does not violate laws or third-party rights.
8. Acceptable Use
You agree not to:
- use the Service for unlawful or abusive purposes;
- interfere with systems, security, or availability;
- reverse engineer or attempt unauthorized access;
- upload illegal, infringing, or harmful content;
- bypass plan restrictions, usage limits, trial controls, or abuse-prevention systems;
- create multiple accounts, reinstall the app, or use technical workarounds to circumvent trial eligibility rules.
9. Subscriptions, Billing, and Free Trial
CalMate may offer free and premium plans.
Plan features, prices, and billing terms are shown in the app.
Premium subscriptions are billed through your app-store account and may auto-renew unless canceled through store settings.
CalMate currently offers an internal 7-day free trial for eligible new users.
Trial eligibility is determined by CalMate using account/device and anti-abuse checks.
Trial eligibility may be denied or revoked where abuse or circumvention is detected.
Deleting an account, logging out, or reinstalling the app does not automatically reset trial eligibility.
Deleting your CalMate account does not automatically cancel an app-store subscription.

Refunds are handled under app-store billing rules unless otherwise required by law.
10. Apple Health and Third-Party Services
If you enable Apple Health, your use of HealthKit is subject to Apple’s terms and permissions.
CalMate may also integrate with third-party providers for infrastructure, billing, analytics/crash monitoring, and AI processing.
Your use of third-party services is subject to those providers’ terms and policies.
CalMate is not responsible for third-party service availability or policies.
11. Privacy
Our Privacy Policy explains how we process personal information:

By using the Service, you acknowledge that processing is carried out as described there.
12. Intellectual Property
All rights in the Service (excluding User Content) are owned by CalMate or its licensors.
You may not copy, distribute, modify, or create derivative works except as permitted by law.
13. Service Availability and Changes
We may modify, suspend, or discontinue features at any time.
We may release updates required for security, compliance, or continued functionality.
14. Disclaimer of Warranties
The Service is provided “as is” and “as available,” without warranties of any kind, to the maximum extent permitted by law.
We do not guarantee uninterrupted availability, complete accuracy, or error-free operation.
15. Limitation of Liability
To the maximum extent permitted by law, CalMate is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/data/business opportunities arising from use of the Service.
Where liability cannot be excluded by law, liability is limited to the minimum extent permitted.
16. Indemnity
You agree to indemnify and hold CalMate harmless from claims, damages, liabilities, and expenses arising from:
- your misuse of the Service;
- your violation of these Terms;
- your violation of third-party rights or applicable law.
17. Termination
We may suspend or terminate access if you violate these Terms or create risk/harm to users or systems.
You may stop using the Service at any time and may request account deletion as available in-app.
18. Governing Law
These Terms are governed by applicable law in your jurisdiction, without limiting mandatory consumer protections that cannot be waived.
19. Changes to Terms
We may update these Terms from time to time.
When updated, the Effective date above will be revised.
Continued use after updates means acceptance of the updated Terms.
